Terms of service
Last updated 19 October 2026
1. Agreement
These terms are an agreement between you and Strawberry Labs LLC ("Berry", "we", "us") for your use of this website, the Berry mobile app and any Berry service we provide (together, the "services"). By using the services you agree to these terms. If you use the services for an organization, you agree on its behalf and confirm you have authority to do so.
If your organization has a separate written agreement with us (such as an order form or subscription agreement), that agreement governs your organization's use of managed Berry and prevails over these terms where they conflict.
2. The services
Berry is an AI workspace that organizations run for their people, either on their own infrastructure ("self-hosted Berry") or as an instance we operate for them ("managed Berry"). The mobile app is a companion that connects to the Berry server an organization runs. We may change or improve the services over time and will give reasonable notice of changes that materially reduce what a paid service provides.
3. Accounts
Accounts in Berry are created and managed by your organization. Keep your sign-in credentials and devices secure and tell your administrator promptly if you suspect unauthorized use. Your organization may suspend or remove your access at any time; questions about your account should go to your organization's administrators.
4. Acceptable use
You agree not to use the services to:
- break the law, infringe others' rights, or violate your organization's policies;
- create or share content that is unlawful, harassing, hateful, sexually exploitative or that promotes violence or self-harm;
- generate malware, attack or probe systems you aren't authorized to test, or circumvent security, budgets or usage limits;
- process personal information without a lawful basis, or make decisions with legal or similarly significant effects on people based solely on AI output;
- misrepresent AI output as human-written where that would mislead, or impersonate others;
- violate the terms of the AI model providers your organization uses;
- interfere with the services, or access them other than through the interfaces we provide.
Use the reporting option in the app to flag harmful or inaccurate responses to your organization.
5. AI output
Berry's answers are generated by AI models and can be incomplete, inaccurate or inappropriate. Review output before relying on it, especially for legal, financial, medical, safety or other important decisions. Actions the agent takes on your instructions, such as running code or changing files, are your organization's responsibility; Berry asks for approval before actions your organization has marked as sensitive.
6. Your content
You and your organization keep all rights in the prompts, files and other material you put into Berry and in the output Berry produces for you ("your content"), to the extent the law allows. For managed Berry, you grant us only the rights needed to host, process and display your content to provide the service, under our agreement with your organization. We don't use your content to train AI models. You are responsible for having the rights to the content you use with Berry.
7. Our property
Except for open-source components provided under their own licenses, the services, including the Berry name, logo, software and documentation, belong to us and our licensors. These terms don't give you any rights in them other than the limited right to use the services as described here. Feedback you give us may be used without obligation to you.
8. Self-hosted software
Berry software you run yourself is provided under the license that accompanies it. Where that license is an open-source license, it governs your use of that software, and these terms apply only to the services we provide around it, such as support. You are responsible for operating, securing and backing up your own installation and for your choice of AI model providers.
9. The mobile app
We grant you a personal, non-exclusive, non-transferable license to use the Berry mobile app on devices you own or control, to access a Berry server your organization provides or the sample workspace used for app review. The app is licensed, not sold.
If you downloaded the app from Apple's App Store: these terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support for the app; if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and Apple has no other warranty obligation for the app; we, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer protection claims; we, not Apple, are responsible for the investigation, defense, settlement and discharge of any claim that the app infringes a third party's intellectual property rights; you confirm you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country and are not on any U.S. Government list of prohibited or restricted parties; and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. If you downloaded the app from Google Play, Google Play's terms also apply to your download.
10. Third-party services
Berry connects to services your organization chooses, such as AI model providers, identity providers, connectors and MCP servers. Their own terms govern your use of them, and we aren't responsible for them.
11. Fees
The mobile app is free. Fees for managed Berry and support are set out in your organization's agreement with us.
12. Suspension and termination
You may stop using the services at any time. We may suspend or end your access to services we provide if you materially breach these terms, if required by law, or to prevent harm to the services or others, and will give notice where reasonable. Sections that by their nature should survive termination will survive.
13. Disclaimers
Except as stated in a written agreement with your organization, the services are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement and that the services will be uninterrupted or error-free. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
14. Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the services. Our total liability for any claim relating to the services is limited to the greater of the amounts paid to us for the services in the twelve months before the claim and one hundred US dollars. These limits don't apply to liability that cannot be limited by law.
15. Indemnity
If you use the services for an organization, the organization will defend and indemnify us against third-party claims arising from its content or its use of the services in breach of these terms, subject to any different allocation in its agreement with us.
16. Governing law and disputes
These terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules. Disputes will be resolved by the competent courts of the United Arab Emirates, unless the law where you live gives you the right to bring a claim in your local courts.
17. Changes to these terms
We may update these terms. We will show the date of the latest version at the top and, for significant changes, give notice through the website, the app or your organization before they take effect. Continuing to use the services after the effective date means you accept the updated terms.
